PURPOSE AND SCOPE

Le présent Cadre officiel définit l’origine, le portage institutionnel, la gouvernance ainsi que les conditions de représentation, d’utilisation, de reproduction, d’adaptation, de traduction et d’autorisation applicables à la Déclaration universelle des droits de l’Arbre et à l’ensemble des instruments développés sous l’autorité de La Compagnie des Papillons Bleus.

This Official Framework defines the origins, institutional stewardship and governance of the Universal Declaration of Tree Rights, together with the conditions governing representation, use, reproduction, adaptation, translation and authorisation applicable to the Declaration and to all instruments developed under the authority of La Compagnie des Papillons Bleus.

Il s’applique notamment :

It applies, in particular, to:

– les quinze engagements destinés aux collectivités locales et régionales ;

Any public authority, organisation, association, NGO, institution, company, media organisation, researcher or other person wishing to use these instruments in an institutional context, represent the initiative, assist with an official adoption or present an interpretation as that of La Compagnie des Papillons Bleus must first consult this Framework and contact La Compagnie directly.

L’ORIGINE DE LA DÉMARCHE

ORIGINS OF THE INITIATIVE

L’Assemblée de l’Arbre est née dans le prolongement de l’appel du 18 novembre 2018. Elle a été conçue comme un espace international de réflexion, de dialogue, de participation et de proposition consacré à la reconnaissance des droits de l’Arbre et à la transformation de la relation entre les sociétés humaines et le vivant.

The Assembly of the Tree emerged from the appeal of 18 November 2018. It was conceived as an international forum for reflection, dialogue, participation and proposals, devoted to the recognition of Tree Rights and to transforming the relationship between human societies and the living world.

Des femmes et des hommes issus de différents pays ont répondu à cet appel. Des citoyens, juristes, scientifiques, professionnels de l’Arbre et de la forêt, artistes, associations, éducateurs et représentants de collectivités ont contribué à nourrir la réflexion et à faire connaître la Déclaration.

Women and men from different countries responded to this appeal. Citizens, legal professionals, scientists, Tree and forestry professionals, artists, associations, educators and representatives of public authorities have contributed to the reflection and helped to raise awareness of the Declaration.

Ces contributions enrichissent la démarche collective. Elles ne confèrent cependant, par elles-mêmes, aucun mandat de représentation de La Compagnie des Papillons Bleus, de la Déclaration universelle des droits de l’Arbre ou de l’Assemblée de l’Arbre.

These contributions enrich the collective initiative. They do not, however, in themselves confer any mandate to represent La Compagnie des Papillons Bleus, the Universal Declaration of Tree Rights or the Assembly of the Tree.

Depuis son lancement, la démarche s’est progressivement structurée afin de relier l’éthique, la science, le droit, la démocratie, la culture, l’éducation et l’action publique.

Since its launch, the initiative has progressively developed in order to connect ethics, science, law, democracy, culture, education and public action.

La première adoption officielle de la Déclaration par une collectivité locale dans le cadre de cette initiative, intervenue à Terrasse-Vaudreuil, au Québec, en 2026, a ouvert une nouvelle phase : celle de la mise en œuvre territoriale et de l’expérimentation institutionnelle.

The first official adoption of the Declaration by a local authority within the framework of this initiative, which took place in Terrasse-Vaudreuil, Québec, in 2026, opened a new phase: territorial implementation and institutional experimentation.

UNE ARCHITECTURE FONDÉE SUR PLUSIEURS INSTRUMENTS COMPLÉMENTAIRES

AN ARCHITECTURE BASED UPON SEVERAL COMPLEMENTARY INSTRUMENTS

La démarche développée par La Compagnie des Papillons Bleus repose sur plusieurs instruments distincts et complémentaires.

The initiative developed by La Compagnie des Papillons Bleus is based upon several distinct and complementary instruments.

1. La Déclaration universelle des droits de l’Arbre

1. The Universal Declaration of Tree Rights

La Déclaration constitue le texte fondateur.

The Declaration is the foundational text.

Ses trois articles suivent une progression éthique et normative :

reconnaître l’Arbre comme un être vivant sensible, source de Vie et bien commun de l’humanité ;

rappeler que la Vie sur la planète dépend de son existence ;

affirmer la responsabilité de l’être humain, qui doit agir avec l’Arbre dans un esprit de fraternité et de solidarité.

Its three articles establish an ethical and normative progression:

recognising the Tree as a sentient living being, a source of Life and a common good of humanity;

recalling that Life on the planet depends upon its existence;

affirming human responsibility to act with the Tree in a spirit of fraternity and solidarity.

La Déclaration constitue un texte de principes éthiques, scientifiques, politiques et juridiques. Elle est destinée à éclairer les politiques publiques, les pratiques institutionnelles, les décisions collectives et le développement futur du droit.

The Declaration is a text of ethical, scientific, political and legal principles. It is intended to inform public policy, institutional practice, collective decision-making and the future development of law.

Elle ne constitue pas, par elle-même, une loi, un règlement, une décision de justice ou un traité international actuellement en vigueur.

It does not, by itself, constitute a statute, regulation, judicial decision or international treaty currently in force.

2. Les quinze engagements destinés aux collectivités

2. The Fifteen Commitments for Local and Regional Authorities

La Compagnie des Papillons Bleus a élaboré un cadre de mise en œuvre comprenant quinze engagements destinés à permettre aux collectivités de traduire progressivement les principes de la Déclaration dans leurs politiques publiques.

La Compagnie des Papillons Bleus has developed an implementation framework comprising Fifteen Commitments intended to enable public authorities to translate the principles of the Declaration progressively into public policy.

Ces engagements concernent notamment la gouvernance, la connaissance du patrimoine arboré, la protection des arbres et de leur milieu vital, la participation citoyenne, l’éducation, l’évaluation des projets, la compensation écologique et la responsabilité envers les générations futures.

These Commitments concern, among other matters, governance, knowledge of tree heritage, the protection of Trees and their living environment, public participation, education, project assessment, ecological compensation and responsibility towards future generations.

Ils forment une feuille de route commune dont les modalités d’application peuvent être adaptées aux compétences, aux ressources, au droit applicable et aux caractéristiques écologiques de chaque territoire.

They form a common roadmap whose implementation arrangements may be adapted to the powers, resources, applicable law and ecological characteristics of each territory.

3. L’Assemblée de l’Arbre

3. The Assembly of the Tree

L’Assemblée de l’Arbre est un espace de réflexion, de dialogue, de participation, de coopération, de circulation des connaissances et de formulation de propositions.

The Assembly of the Tree is a forum for reflection, dialogue, participation, cooperation, the circulation of knowledge and the formulation of proposals.

Elle peut réunir des citoyens, des scientifiques, des juristes, des collectivités, des élus, des associations, des professionnels, des éducateurs, des artistes et des représentants de la société civile.

It may bring together members of the public, scientists, legal professionals, public authorities, elected officials, associations, professionals, educators, artists and representatives of civil society.

L’Assemblée de l’Arbre est une instance consultative. Elle n’exerce aucun pouvoir juridictionnel, réglementaire ou administratif et ne se substitue pas aux autorités publiques compétentes.

The Assembly of the Tree is an advisory body. It exercises no judicial, regulatory or administrative power and does not replace the competent public authorities.

Des Assemblées de l’Arbre territoriales peuvent être constituées par les collectivités engagées dans la mise en œuvre de la Déclaration, conformément au cadre institutionnel et aux règles applicables à chaque territoire.

Territorial Assemblies of the Tree may be established by public authorities engaged in implementing the Declaration, in accordance with the institutional framework and the rules applicable to each territory.

4. Le projet de Convention internationale des droits de l’Arbre

4. The Proposed International Convention on Tree Rights

La Convention internationale des droits de l’Arbre existe actuellement sous la forme d’un projet d’instrument international structuré et publié.

The International Convention on Tree Rights currently exists in the form of a structured and published draft international instrument.

Elle a vocation à proposer aux États et aux organisations internationales compétentes un cadre juridique permettant de renforcer progressivement la protection des arbres et de traduire les principes de la Déclaration dans un futur instrument conventionnel.

It is intended to propose to States and competent international organisations a legal framework through which the protection of Trees may be progressively strengthened and the principles of the Declaration translated into a future treaty-based instrument.

Elle ne constitue pas, à ce jour, un traité international en vigueur. Elle n’a pas encore été adoptée, signée ou ratifiée par des États et ne produit actuellement aucune obligation conventionnelle internationale.

It is not currently an international treaty in force. It has not yet been adopted, signed or ratified by States and does not presently create any international treaty obligations.

Les collectivités locales et régionales n’adhèrent pas juridiquement à la Convention. Elles peuvent adopter la Déclaration et les quinze engagements, expérimenter leur mise en œuvre et contribuer, par leur expérience, au développement futur du cadre international.

Local and regional authorities do not legally accede to the Convention. They may adopt the Declaration and the Fifteen Commitments, experiment with their implementation and contribute through their experience to the future development of the international framework.

5. Le Registre international des collectivités signataires

5. The International Register of Signatory Authorities

Le Registre international recense les collectivités ayant adopté officiellement la Déclaration et les quinze engagements conformément à la procédure établie.

The International Register records the public authorities that have officially adopted the Declaration and the Fifteen Commitments in accordance with the established procedure.

Il assure la traçabilité des adoptions, donne une visibilité aux engagements territoriaux, facilite les échanges d’expériences et contribue à la constitution d’un réseau international.

It ensures the traceability of adoptions, gives visibility to territorial commitments, facilitates the exchange of experience and contributes to the development of an international network.

L’inscription au Registre ne crée, par elle-même, aucun pouvoir supplémentaire, aucune personnalité juridique spéciale et aucune obligation internationale nouvelle.

Registration does not, by itself, create any additional power, special legal personality or new international obligation.

UNE DÉMARCHE AUTONOME, OUVERTE AU DIALOGUE

AN AUTONOMOUS FRAMEWORK OPEN TO DIALOGUE

La Déclaration universelle des droits de l’Arbre constitue un cadre éthique, normatif, juridique, démocratique et institutionnel autonome.

The Universal Declaration of Tree Rights constitutes an autonomous ethical, normative, legal, democratic and institutional framework.

Elle partage avec le mouvement des Droits de la Nature la volonté de dépasser une conception exclusivement utilitaire du vivant et de reconnaître la valeur intrinsèque des êtres et des systèmes naturels.

It shares with the Rights of Nature movement the intention to move beyond an exclusively utilitarian conception of the living world and to recognise the intrinsic value of living beings and natural systems.

Elle ne constitue cependant ni une émanation, ni une déclinaison institutionnelle, ni une extension du mouvement des Droits de la Nature.

It does not, however, constitute a derivative, institutional branch or extension of the Rights of Nature movement.

Ces approches peuvent dialoguer, coopérer et se compléter tout en conservant leurs fondements, leurs architectures et leurs objectifs propres.

These approaches may engage in dialogue, cooperate and complement one another while retaining their own foundations, architectures and objectives.

La reconnaissance des droits de l’Arbre ne doit pas être automatiquement confondue avec l’attribution d’une personnalité juridique.

The recognition of Tree Rights must not automatically be confused with the attribution of legal personhood.

Dans certains systèmes juridiques, la personnalité juridique peut constituer l’un des mécanismes permettant de protéger une entité naturelle. Elle n’est toutefois ni le fondement nécessaire, ni l’objectif exclusif de la Déclaration universelle des droits de l’Arbre.

In certain legal systems, legal personhood may constitute one mechanism for protecting a natural entity. It is, however, neither a necessary foundation nor the exclusive objective of the Universal Declaration of Tree Rights.

Les droits de l’Arbre peuvent également être mis en œuvre par des obligations imposées aux autorités publiques, des règles d’urbanisme et d’aménagement, des procédures de prévention, des mécanismes de représentation ou de protection, des normes environnementales et des obligations de restauration.

Tree Rights may also be implemented through duties imposed upon public authorities, planning and land-use rules, preventive procedures, representation or protection mechanisms, environmental standards and restoration obligations.

La Compagnie des Papillons Bleus est l’organisation fondatrice et officiellement porteuse de la Déclaration universelle des droits de l’Arbre et de son développement institutionnel.

La Compagnie des Papillons Bleus is the founding organisation and official steward of the Universal Declaration of Tree Rights and its institutional development.

Elle assure notamment le développement, la conservation, l’actualisation, la présentation et la diffusion institutionnelle :

de la Déclaration universelle des droits de l’Arbre ;

des quinze engagements destinés aux collectivités ;

de l’Assemblée de l’Arbre ;

du projet de Convention internationale des droits de l’Arbre ;

du Registre international des collectivités signataires ;

des documents, outils et procédures de mise en œuvre qui leur sont associés.

It is responsible, in particular, for the development, preservation, updating, presentation and institutional dissemination of:

the Universal Declaration of Tree Rights;

the Fifteen Commitments for Local and Regional Authorities;

the Assembly of the Tree;

the proposed International Convention on Tree Rights;

the International Register of Signatory Authorities;

and the documents, tools and implementation procedures associated with them.

Ricardo Rey est l’auteur et l’initiateur de la Déclaration universelle des droits de l’Arbre, le fondateur de l’Assemblée de l’Arbre et le président de La Compagnie des Papillons Bleus.

Ricardo Rey is the author and initiator of the Universal Declaration of Tree Rights, the founder of the Assembly of the Tree and the President of La Compagnie des Papillons Bleus.

Les contributions de juristes, scientifiques, traducteurs, professionnels, artistes, associations, élus ou citoyens sont reconnues comme des apports à la réflexion et au développement de la démarche. Elles ne confèrent aucun droit de représentation institutionnelle en l’absence d’un mandat écrit.

Contributions from legal professionals, scientists, translators, practitioners, artists, associations, elected officials or members of the public are recognised as contributions to the reflection and development of the initiative. They confer no institutional representation rights in the absence of a written mandate.

Aucune personne, association, collectivité, institution ou organisation extérieure n’est autorisée à représenter La Compagnie des Papillons Bleus, la Déclaration universelle des droits de l’Arbre ou l’Assemblée de l’Arbre sans un mandat écrit, exprès, précisément défini et en cours de validité délivré par La Compagnie des Papillons Bleus.

No person, association, public authority, institution or external organisation is authorised to represent La Compagnie des Papillons Bleus, the Universal Declaration of Tree Rights or the Assembly of the Tree without an express, precisely defined and currently valid written mandate issued by La Compagnie des Papillons Bleus.

La participation à une réunion, une consultation, un groupe de réflexion, une traduction, une publication, une interview, un événement ou un travail collectif ne constitue pas, par elle-même :

un mandat de représentation ;

une délégation de compétence ;

une autorisation générale de communication ;

un partenariat institutionnel ;

une autorisation d’accompagner des collectivités ;

une autorisation de recevoir ou de traiter des demandes au nom de la Déclaration ;

ou un droit de parler officiellement au nom de la démarche.

Participation in a meeting, consultation, working group, translation, publication, interview, event or collective work does not, in itself, constitute:

a mandate of representation;

a delegation of authority;

a general communication authorisation;

an institutional partnership;

authorisation to assist public authorities;

authorisation to receive or process requests on behalf of the Declaration;

or the right to speak officially on behalf of the initiative.

A specific authorisation to reproduce, translate, participate, publish or cooperate may never be interpreted as a general mandate.

Sous réserve des exceptions prévues par le droit applicable, une autorisation écrite préalable de La Compagnie des Papillons Bleus est requise pour :

reproduire intégralement ou substantiellement les documents institutionnels de la Déclaration ;

modifier, adapter ou intégrer ces documents dans un autre texte ou instrument ;

réaliser ou publier une traduction présentée comme officielle ;

utiliser les logos, visuels, signes distinctifs ou éléments d’identité graphique ;

présenter une personne ou une organisation comme représentante, partenaire ou relais officiel ;

organiser une collecte de fonds au nom de la Déclaration ou de l’Assemblée de l’Arbre ;

accompagner, conseiller ou représenter une collectivité dans le cadre de la procédure officielle d’adoption, au nom de La Compagnie des Papillons Bleus ou de la Déclaration universelle des droits de l’Arbre ;

accompagner une collectivité ou une institution au nom de la démarche ;

créer une Assemblée de l’Arbre présentée comme intégrée au dispositif international ;

utiliser officiellement les quinze engagements, le Registre international, le Passeport de l’Arbre Gardien ou tout autre outil développé par La Compagnie ;

recevoir ou traiter au nom de la Déclaration les demandes de collectivités, d’institutions ou d’organisations ;

publier une communication laissant entendre l’existence d’une validation, d’une délégation ou d’un partenariat non formalisé par écrit ;

utiliser les documents, dénominations ou signes distinctifs à des fins commerciales, promotionnelles ou de collecte de fonds.

Subject to the exceptions provided by applicable law, the prior written authorisation of La Compagnie des Papillons Bleus is required in order to:

reproduce all or a substantial part of the Declaration’s institutional documents;

modify, adapt or incorporate those documents into another text or instrument;

prepare or publish a translation presented as official;

use logos, visual materials, distinctive signs or graphic identity elements;

present a person or organisation as an official representative, partner or relay;

organise fundraising in the name of the Declaration or the Assembly of the Tree;

assist, advise or represent a public authority in connection with the official adoption procedure on behalf of La Compagnie des Papillons Bleus or the Universal Declaration of Tree Rights;

assist a public authority or institution on behalf of the initiative;

establish an Assembly of the Tree presented as part of the international framework;

make official use of the Fifteen Commitments, the International Register, the Guardian Tree Passport or any other tool developed by La Compagnie;

receive or process requests from public authorities, institutions or organisations on behalf of the Declaration;

publish any communication implying the existence of validation, delegation or partnership that has not been formalised in writing;

use the documents, names or distinctive signs for commercial, promotional or fundraising purposes.

Every authorisation must specify its purpose, duration, territorial scope, relevant media and conditions of use.

Elle ne peut être transférée, étendue ou sous-déléguée sans l’accord écrit préalable de La Compagnie des Papillons Bleus.

It may not be transferred, extended or sub-delegated without the prior written agreement of La Compagnie des Papillons Bleus.

Toute collectivité souhaitant adopter officiellement la Déclaration universelle des droits de l’Arbre est invitée à prendre directement contact avec La Compagnie des Papillons Bleus.

Any public authority wishing to adopt the Universal Declaration of Tree Rights officially is invited to contact La Compagnie des Papillons Bleus directly.

Le dialogue préalable permet notamment :

de transmettre les versions officielles et actualisées des documents ;

de présenter la portée exacte de la Déclaration ;

de distinguer la Déclaration du projet de Convention internationale ;

de présenter les quinze engagements ;

de préparer l’acte de délibération, la résolution ou l’instrument institutionnel approprié ;

d’organiser la mise en œuvre progressive ;

de procéder à l’inscription au Registre international des collectivités signataires.

The preliminary dialogue makes it possible, in particular, to:

provide the official and current versions of the relevant documents;

explain the precise scope of the Declaration;

distinguish the Declaration from the proposed International Convention;

present the Fifteen Commitments;

prepare the appropriate deliberation, resolution or institutional instrument;

organise progressive implementation;

complete registration in the International Register of Signatory Authorities.

Chaque collectivité demeure libre d’adopter les décisions relevant de ses compétences et conformément au droit qui lui est applicable.

Each public authority remains free to adopt decisions within the scope of its powers and in accordance with the law applicable to it.

The designations “Déclaration universelle des droits de l’Arbre” and “Universal Declaration of Tree Rights™” have been claimed and used as trademarks and distinctive signs since 2018. The French designation has been the subject of a trademark application in France.

Ces dénominations bénéficient également, selon les territoires et les usages concernés, des droits résultant notamment de leur antériorité d’usage, des contenus originaux, des noms de domaine et des activités institutionnelles de La Compagnie des Papillons Bleus. Toute utilisation non autorisée susceptible de créer une confusion ou de suggérer une affiliation, une autorisation, une validation, une représentation ou un partenariat officiel pourra faire l’objet de mesures juridiques appropriées.
